By accessing or using Wisegraph, you represent that you are at least 18 years of age or the age of majority in your jurisdiction. If you are under 18 (but at least 13 years of age), you may only use the Service with the verifiable consent of a parent or legal guardian who agrees to be bound by these Terms. Wisegraph is available to both individual users and educational institutions. If you register an account on behalf of an institution, you represent that you have the authority to bind that institution to these Terms. You agree to provide accurate registration information and to keep your credentials confidential. You are strictly prohibited from sharing your account credentials with others; any activity occurring under your account is your sole responsibility.
2. Acceptable Use Policy (Permitted and Prohibited Uses)
You agree to use Wisegraph solely for lawful purposes. You are solely responsible for ensuring your use of the Service complies with any applicable academic integrity policies, institutional codes of conduct, or laws. You are strictly prohibited from using the Service to: (a) reverse engineer, decompile, or attempt to discover the source code or underlying models of the Service; (b) scrape, mine, or use automated systems to extract data from the Service; (c) upload content that contains viruses, malware, or illegal material; or (d) disrupt or interfere with the security or performance of the platform. Wisegraph reserves the right to monitor usage for technical abuse and may terminate accounts found violating these restrictions without refund.
3. AI-Generated Content - Disclaimers on Accuracy and Limitations
Wisegraph utilizes third-party Large Language Models (LLMs), including OpenAI and Gemini, to generate study materials. You acknowledge that AI services are probabilistic and may produce "hallucinations," errors, or offensive content. Wisegraph makes no warranties regarding the accuracy, completeness, or reliability of any AI-generated output. You agree to independently verify all study materials, concept maps, and summaries generated by the Service. You should not rely on Wisegraph as a substitute for professional instruction or as the sole source of truth for academic subjects.
4. Intellectual Property and Content Ownership
You retain ownership of the content you upload (e.g., notes, textbook excerpts) ("User Content"). However, by uploading User Content, you grant Wisegraph a worldwide, non-exclusive, royalty-free license to use, process, and display such content solely to provide the Service. You represent and warrant that you own or possess the necessary rights/licenses for any User Content you upload, including copyrighted textbook material. Regarding AI-generated output: Subject to your compliance with these Terms, Wisegraph assigns to you all its right, title, and interest in the output generated by the Service for your personal use.
5. Privacy and Data Protection
Your privacy is important to us. To provide our Services, Wisegraph transmits user inputs to third-party AI processors, including OpenAI and Google (Gemini). By using the Service, you consent to this transfer and processing. While Wisegraph does not currently use your personal data to train native AI models, we reserve the right to aggregate and anonymize data for marketing and service improvement purposes. 6. Payment, Subscription, and Cancellation Terms
Wisegraph offers Freemium and Paid tiers. The Freemium tier grants limited lifetime credits, which Wisegraph may revoke, modify, or reinstate at its sole discretion. For Paid subscriptions, fees are billed in advance on a recurring basis. All payments are non-refundable. You may cancel your subscription at any time via your account settings; however, cancellation must be effected prior to the renewal date to avoid subsequent charges. No refunds or credits will be issued for partial months or unused service. Account tier changes (e.g., Scholar to Educator) must be requested through Customer Support.
7. Termination of Service
Wisegraph reserves the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to: (a) violation of these Terms; (b) account sharing or unauthorized access; or (c) any use of the Service deemed by Wisegraph to be abusive or detrimental to the platform or other users. You acknowledge that adherence to academic honesty policies is your sole responsibility. Wisegraph is not liable for any academic, disciplinary, or professional consequences (including but not limited to expulsion, suspension, or loss of credit) resulting from your use of the Service or the termination of your account. Upon termination, your right to use the Service will immediately cease.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WISEGRAPH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WISEGRAPH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR THAT THE AI-GENERATED RESULTS WILL BE ACCURATE OR RELIABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WISEGRAPH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR ACADEMIC STANDING. WISEGRAPH'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO WISEGRAPH IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).
10. Indemnification
You agree to defend, indemnify, and hold harmless Wisegraph, its officers, directors, and employees from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right, including without limitation any copyright or privacy right (e.g., uploading textbooks or content you do not own).
11. General Legal Provisions
These Terms shall be governed by and construed in accordance with the laws of Canada and the province of [Province, e.g., Ontario/BC]. Any dispute arising from these Terms shall be resolved through binding arbitration in [City, Province], and you waive any right to participate in class action lawsuits. Wisegraph reserves the right to modify these Terms at any time. Changes are effective immediately upon posting to the website. Your continued use of the Service constitutes acceptance of the revised Terms.
